These Terms of Use (the “Terms”) are an agreement between you and OneX Engineering (“we”, “us”) and cover the GuideAI app for iPhone, Apple Watch and their extensions, and the guideaiapp.com website (together, “GuideAI”). Please read them, especially the navigation safety, warranty and limitation of liability sections. Our Privacy Policy explains how we handle your information.
By downloading, opening or using GuideAI you agree to these Terms. If you do not agree, do not use GuideAI. You must be at least 13 years old to use GuideAI. If you are under the age of majority where you live, a parent or guardian must agree to these Terms for you.
We grant you a personal, non-exclusive, non-transferable, revocable license to use GuideAI on Apple devices that you own or control, as permitted by the Usage Rules in Apple’s Media Services Terms and Conditions. You may not copy, modify, reverse engineer, resell or redistribute GuideAI, use it to break the law or infringe anyone’s rights, interfere with its operation, or scrape or overload the services it relies on. We and our licensors keep all rights not expressly granted to you.
You own the content you create in GuideAI (saved places, trips, notes, photos, chats). You are responsible for content you choose to share, for example through a share link, and you must have the right to share it.
Pay attention to the road. Always obey posted signs, traffic signals, traffic laws, and the directions of police, and drive for the road, weather and traffic conditions you actually see. Do not type, browse or otherwise handle your phone while driving. Set your route before you start, use voice guidance or CarPlay, or let a passenger operate the app.
Directions, routes, turn and lane guidance, speed limits, speed-camera locations, tunnel and road information, traffic, estimated travel and arrival times, parking locations, and weather can be incomplete, inaccurate or out of date. Roads close, change or become unsafe; posted limits change; cameras move or are added; and GPS can be wrong, particularly in cities, tunnels and bad weather. Road data comes from third parties, including Apple Maps and community-edited OpenStreetMap, that we do not control. If GuideAI conflicts with a sign, a road marking, or what you see, follow the sign and the road.
Speed-camera alerts are a convenience only. They do not tell you that it is safe or lawful to drive at any particular speed, they may miss cameras or show cameras that no longer exist, and you are always responsible for driving within the posted limit. You are responsible for checking that a route is suitable, safe and legal for you, your vehicle, and how you are travelling (for example by foot, bike or transit), and for knowing and following the laws that apply where you drive, including laws on using a phone while driving.
Workout, heart-rate, sleep, activity and other health and fitness features are for general fitness and informational purposes only. They are not medical devices and do not diagnose, treat or prevent any condition. Readings and estimates (such as calories, heart-rate zones, effort scores and VO₂ max) may be inaccurate. Talk to a doctor before starting an exercise program, and stop exercising and get help if you feel unwell. In an emergency, call 911.
GuideAI’s chat and planning features run AI models on your device. AI output can be wrong, incomplete or out of date, and it may describe places, hours, prices, events or directions that are not accurate. Check important information yourself before relying on it, and do not rely on AI output for medical, legal, financial or safety decisions.
GuideAI uses data and services from third parties, each subject to its own terms. These include:
Third-party content is provided “as is”. We are not responsible for third-party services, their availability, or their content, and a link to a third party is not an endorsement.
GuideAI is provided free of charge. We may add, change, suspend or stop any feature, and features may depend on your device, operating system, location, permissions or third-party availability. Some features are available only in some places.
TO THE FULLEST EXTENT PERMITTED BY LAW, GUIDEAI AND ALL CONTENT, DATA AND SERVICES MADE AVAILABLE THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT GUIDEAI WILL BE ACCURATE, COMPLETE, RELIABLE, CURRENT, UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT ANY ROUTE, SPEED LIMIT, SPEED-CAMERA LOCATION, ESTIMATED TIME, WEATHER, HEALTH READING OR AI RESPONSE IS CORRECT OR SAFE.
Some states do not allow the exclusion of certain implied warranties, so some of these exclusions may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY LAW, ONEX ENGINEERING AND ITS OWNERS, EMPLOYEES, CONTRACTORS, LICENSORS AND DATA PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL OR USE, ARISING OUT OF OR RELATING TO GUIDEAI OR THESE TERMS, INCLUDING DAMAGES ARISING FROM RELIANCE ON DIRECTIONS, ROAD, SPEED-LIMIT, SPEED-CAMERA, TRAFFIC, WEATHER, HEALTH OR AI INFORMATION, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR ANY OTHER THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF THOSE DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO GUIDEAI OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR GUIDEAI IN THE 12 MONTHS BEFORE THE CLAIM AROSE AND (B) FIFTY U.S. DOLLARS (US $50).
These limits apply even if a remedy fails of its essential purpose. Some states do not allow the exclusion or limitation of certain damages, including for personal injury or for gross negligence or willful misconduct, so some of these limits may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
To the extent permitted by law, you agree to defend, indemnify and hold harmless OneX Engineering from claims, losses and expenses (including reasonable attorneys’ fees) arising from your misuse of GuideAI, your violation of these Terms or of any law, or content you share through GuideAI.
You can stop using GuideAI at any time by deleting the app. We may suspend or end your license if you violate these Terms. Sections 3 through 6 and 8 through 14 survive termination.
These Terms are between you and OneX Engineering only, not Apple Inc. (“Apple”). We, not Apple, are solely responsible for GuideAI and its content. Apple has no obligation to provide maintenance or support for GuideAI. If GuideAI fails to conform to an applicable warranty, you may notify Apple and Apple will refund any purchase price you paid for it; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to GuideAI. Apple is not responsible for addressing any claims by you or any third party relating to GuideAI or your possession or use of it, including product liability claims, claims that GuideAI fails to conform to a legal or regulatory requirement, claims under consumer protection, privacy or similar laws, or claims that GuideAI or your possession and use of it infringes a third party’s intellectual property rights; we, not Apple, are responsible for investigating, defending, settling and discharging any such intellectual property claim. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties. You must comply with applicable third-party terms (such as your wireless carrier’s) when using GuideAI. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
These Terms are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute that is not resolved informally will be brought in the state or federal courts located in the State of Texas, and you and we consent to their jurisdiction, except that either of us may bring an individual claim in small-claims court. Before filing a claim, please contact us at [email protected] so we can try to resolve it informally.
We may update these Terms. We will post the new version here with a new effective date and, for material changes, give notice in the app or on this page before they take effect. If you keep using GuideAI after changes take effect, you accept the updated Terms. If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. These Terms and our Privacy Policy are the entire agreement between you and us about GuideAI. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.
